If the dispute cannot be resolved amicably between the parties, it will be submitted to binding arbitration. Prior to seeking arbitration, you must submit your written complaint to YHB via e-mail.
Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial [or other] Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. You agree now that your damages will be limited to a refund of your purchase price. Consequential and punitive damages will not be permitted.
7. Governing Law.
Your use of this Site and any dispute arising out of such use of the website is subject to the laws of the State of Oregon.
8. Termination.
YHB may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Entire Agreement; Integration Clause.
This Agreement contains the entire agreement between the parties hereto and supersedes any and all prior written and/or oral agreements. This Agreement may be altered or modified only in writing signed by the parties hereto.

If these Terms and Privacy Policy, or any part therein, is construed to be invalid or unenforceable, it shall not affect the validity or enforceability of the remainder of the Terms and Privacy Policy which shall be given full force and effect.
